Hi,My husband is dying we have a french property and no will.Do i have to inform them of his death.Or on sale?

Q) French sucssesion law states that the husbands half of the property is to be divided between your children,this is not a problem but two of the children are miners it would be nice to keep the house so we can take holidays together,i thought if we kept quite we would not get into any taxes yet,only then when we want to sell at a later date we would pay the tax then,but i dont know if this is legal only that if we all dont want to sell maybe we can just carry on as before?

A) I would seriously consider getting advice from a British Law firm, if you are British that is I dont understand why you dont have a will though, do you have one for your permanent home? Anyone who owns anything should have a will, if you are a resident of the U.K. or Ireland I think the will you have there should count but you must seek advice before you risk loosing anything. anyway as you say, you would like to keep it and use it which is great for you all but should'nt you sort out the legalities now in case the unfortunate happens to you? ~Where would your children be then with a property in France that they may not inherit? Do check it out ring up a firm and they may even tell you for free. You can still make a will while your husband is still with you, there are legal protocols to allow for this if he can still comprehend. Good luck.

A) The IR is infomed about transfers of properties in France under the Double Taxation agreement between the two countries. If they are only paying a peppercorn rent, I can't see that you would have much of a tax liability on this income - I'm sure you could pay for enough repairs to cover this and reduce your profit to nil!

A) You might be able to if you also owned a property in France (ie if your UK house was a holiday house). The financial regulations of each country differ, and therefore financial institutions have to be registered in that particular country in order to offer certain financial services. The issue with a mortgage, for example, is that if a French bank lent to you, they wouldn't be able to repossess a UK house in the event of non-payment. If the mortgage was guaranteed on a french property, of course, there wouldn't be a problem.

Q) A guy on Radio 2 today said that he had spent the weekend in France and the French were having a right good laugh at the attempted bombings in London and Glasgow. He said the French were in effect saying 'serves the British right for being Bush's poodle and following him into Iraq'. If that is true it's disgusting. They may well be right in their analysis (i.e. if we weren't in Iraq we may not be so much at risk now at home) but to make fun out of it, and get some perverted joy at the terrorism we now face here is despicable. Maybe we should laugh back in their faces when their muslims and North African immigrants start rioting across the whole country and burning cars and property in protest at their racist treatment by French Govt, like they all did last year. Vive la France! I don't bloody think so. European friends and partners? Like f**k!

Would knocking out my chimney breast lose property value?

A) Very expensive to put steel in to suport rest of c/stack,Better way but still expensive is to have all c/stack removed from the top down.you will have mess in every room.plaster to repair , floors to repair.but its a job worth doing and it will add value to house.As for advice from TA-DAH survayor will not check the work.no way.He will say part of c/stack has been removed and you will have to pay a structual engenier to prove that its been done corectly and is safe.with no c/stack no problem.as i all ways say you must speak to a pro. 2 men 2 days £400. 1 rubish skip £150. 1 plasterer 2 days £200. 1 man repair floors skirting ect,2 days £200.Say top side £1200. max.you can double that and more for steel.good luck.

Questions in regards to a French Drain Installation.?

Q) My neighbors yard is on a slope and higher than mine. It drains always onto my long driveway. There is about 14 feet between their house and my driveway. I want to install a French Drain to deal with the excess water I always get that just lays on my driveway. Should I put the drain on the border of the property, or should I put it directly against my driveway? Also, does a French Drain need to have an exit point to drain out to the street or can it just exit all downward and be completely covered and not exposed? Thanks for any help you can provide! Border of the property is about halfway between their house and my driveway. Also, their are sprinkler systems in both yards.

A) what sensibleman described is a french drain even if he doesn't know it your idea of placing along driveway is good and drain should have outlet unless it flows into a deeper drainage well but you should check local ordinances about drain outlets flowing over any sidewalks as this can cause injuries due to someone slipping on wet surfaces
